January 24, 2013 – Salvia legal status update 2013

The future is not looking very bright for Sally D – at least not in the USA. There are currently only 19 states left that allow adults to legally purchase Salvia divinorum. Another four states considering measures to ban the plant or prohibit its distribution. If you live in one of these states, please take action and contact your representatives!

The states are:

Montana: House Bill 140 would add S. divinorum and salvinorin A to Schedule I in the state. As of 14 January 2013, the bill is pending House Judiciary Committee review.

New York: Senate Bill 1454 would prohibit any sale or distribution of S. divinorum. It does not regulate salvinorin A, nor does it prohibit possession or cultivation (though it would prohibit anyone from selling cuttings to people in New York). On 9 January 2013, the bill was referred to Consumer Protection prior to filing. It is identical with Assembly Bill 1033, which was referred to the Assembly Codes Committee on 9 January 2013.

Texas: House Bill 124, filed 12 November 2012, would add S. divinorum and salvinorin A to Penalty Group 3 of the state’s Controlled Substances Act. It also includes ‘any compound’ from the plant… This would mean that chlorophyll would be included in Penalty Group 3 as well if the bill passes?

Rhode Island: House Bill 5063 would add S. divinorum and salvinorin A to Schedule I of the state’s Controlled Substances Act. It was introduced 10 January 2013 and referred to the House Judiciary.
